High Court Upholds FITs Appeal!

 

Justice Mitting today deemed that the decision made by the Department of Energy and Climate Change to reduce the Feed-in Tariff rates from 43p to 21p per kWh was unlawful .

The government ignored its own three month consultation period, due to finish on the 23rd  December to make the change by the 12th December 2011 and is now seeking its own appeal on Justice Mitting's decision.

The Judge went on to speculate as to the legality of the Secretary of State, Chris Huhne’s power to make decisions on the Feed-in Tariff rate under the Energy Act 2008.

Lobby groups, campaigners and charities such as Friends of the Earth have immediately called for the government to come up with new proposals to adjust the tarrif to fall in line with reducing installation costs.

It is unclear as to where this will lead the industry in the short term as many companies within the solar industry are shedding thousands of related jobs at the moment. Carillion are putting 4,500 staff on notice, due to cancelled projected related to the FITs reduction.
